Balancing privacy with lawful searches

How to search marital status records in Hong Kong

Agreements & documents Reading time: about 5 minutes
Key points
  • Marriage records are used for immigration, tax, insurance and more. The Immigration Department keeps them permanently, and they have legal effect.
  • To check a marriage you can apply for a “search of marriage records” or a “certificate of no marriage record”. Only the person concerned or an authorised person may apply.
  • The fee is about HK$140 to HK$280, processing takes 7 to 10 working days, and you must collect the certified copy in person.
  • Hong Kong and Mainland marriage systems are not linked. For the Mainland to recognise a Hong Kong marriage, notarisation and attestation must be done first.

In Hong Kong, many people need to check marriage records because of marriage, divorce, visas or immigration, to confirm their own or someone else’s marital status.

To go about checking marital status, you can apply for a “search of marriage records” or a “certificate of no marriage record”. The two procedures are different.

Checking a Marriage Matters in Everyday Life

Many people think you only need to check a marriage when marrying or divorcing, but it touches everyday life.

You must state your marital status truthfully when applying for immigration, registering joint property ownership, filing tax returns, or even arranging school or medical insurance.

If it is filled in wrongly, it may be treated as giving false information and could lead to legal liability, affecting your credit and rights.

Knowing how to check marriage records is an important step in protecting your own rights.

That is why every marriage is formally registered and kept safely by the government.

These documents are kept permanently by the Hong Kong Immigration Department. They are the legal basis of a marriage and an important part of a person’s identity records.

If a bigamy or inheritance dispute arises later, the marriage record is an important legal document recognised by the court.

What Marriage Records Show, and Privacy Protection

Hong Kong’s marriage registration documents do not simply record “married” or “not married”.

A marriage record search shows the exact date, place and registering office of the marriage, and both parties’ names and identity card numbers.

These details are an important reference when handling documents, notarisation, immigration and even international marriages.

A marriage check looks at more than “married” or “unmarried”; it includes the specific details of the registration.

However, checking someone else’s marital status must still respect personal privacy and cannot be done casually.

To check someone else’s marriage record, you must have a proper reason or authorisation, for example a journalist reporting in the public interest, or a lawyer acting to carry out a court order.

Otherwise, the Immigration Department may refuse the application, to prevent personal data from being misused.

Please note

  1. Checking a marriage is a legitimate right, but you must still comply with the Personal Data (Privacy) Ordinance (Cap. 486) and not misuse other people’s information.

Two Official Ways to Check a Marriage

Hong Kong mainly offers two ways to check a marriage: a “search of marriage records” and a “certificate of no marriage record”.

What is a “search of marriage records”?

To find out whether someone (yourself, or another person who has authorised you) registered a marriage in Hong Kong, you can apply for a “search of marriage records”. It shows the date and place of registration and the marital status, and can be used for:

  • Inheritance
  • Divorce procedure
  • Court documents
  • Family reunion applications

What is a “certificate of no marriage record”?

If you have never registered a marriage in Hong Kong, you can apply to the Immigration Department for a “certificate of no marriage record”. It is often used for marrying overseas or for visa applications, works like a “certificate of single status”, and has formal legal effect.

Who can apply, and eligibility limits

  • The person named in the record, that is, the bride or groom, can apply directly.
  • For a person under 18, a parent or legal guardian applies on their behalf.
  • Others, such as lawyers, the media or third parties, must give a reasonable reason and supporting documents. Otherwise, even if they have the person’s identity card number, they cannot find the record.

Special cases and approval

If the applicant is not the person concerned and cannot give written authorisation, the Immigration Department will look at the purpose of the application, for example whether it involves handling an estate or tracing lost relatives.

If the Immigration Department finds the reason insufficient, or that privacy may be leaked, it may also refuse the application, to balance public transparency with privacy protection.

Application Process and Fees for Marriage Records

You can apply online, by post or in person.

Apply online

Applicants can use the Hong Kong government one-stop site or the Immigration Department’s e-platform, fill in the form and upload documents. Payment methods include credit card, FPS, Alipay, WeChat Pay and UnionPay QuickPass.

When finished, you will receive an electronic confirmation stating the date and place of collection.

Applying by post suits people overseas

If you live overseas or cannot go online, you can choose to apply by post.

Send the completed application form, with a cheque or cashier’s order made payable to “The Government of the Hong Kong Special Administrative Region”, to the Marriage Registration and Records Office.

Please note

  1. When posting, use registered mail to keep the documents safe. If documents are missing or the information is wrong, the Immigration Department will notify you separately to provide more.

Applying in person and the appointment system

Please note

  1. Before applying in person, call to make an appointment. Places on the day are limited.

If you want it done the same day, you can go to the Marriage Registration and Records Office in person. There is an electronic queuing system, and you must bring your original Hong Kong identity card or passport for checking.

Fees and processing time

Fees
“Search of marriage records” HK$140 each time
“Certificate of no marriage record” Paid on collection (about HK$280)

Processing normally takes 7 working days. If the record needs extra checking or enquiries across departments, it may take 10 working days.

When it is ready, the applicant must collect the certified copy in person and sign to confirm. If it is not collected within six months, the application lapses automatically.

Checking Marital Status in Hong Kong and the Mainland: Points to Note

If you marry in Hong Kong, can the Mainland find out?

Hong Kong and Mainland marriage registration systems are not fully linked at present. In general, the Mainland cannot find Hong Kong marriage records.

In other words, if you marry in Hong Kong, your marital status on your Mainland household register will still show “unmarried”, unless you submit a notarised copy of your Hong Kong marriage certificate to change it.

For the Mainland to recognise a Hong Kong marriage, notarisation and attestation must be completed first.

How to get the Mainland to recognise a Hong Kong marriage record

If you are in a cross-border marriage between Hong Kong and the Mainland and want the Mainland to formally recognise your marital status, you must complete “notarisation of the Hong Kong marriage certificate” and “attestation of its legal effect in China”.

This is usually done by a Hong Kong lawyer, and the cost ranges from about HK$1,000 to HK$2,000.

Please note

  1. After notarisation and attestation, you can go to the local police station where your household is registered and change your marital status from “unmarried” to “married”.

Hong Kong and Mainland Records After a Divorce

For a divorce in Hong Kong, the court issues a decree absolute (the final order that ends the marriage) as the formal record of the divorce. This document is protected by Hong Kong law, just like the marriage record.

Please note

  1. If the divorce has not been reported to the Mainland civil affairs bureau or notarised, the Mainland record may not be updated, which can delay remarriage after divorce.

Marriages With a Foreign Element and Limits on Searches

Besides Mainland-Hong Kong marriages, there are many “marriages with a foreign element” involving a foreign spouse. Hong Kong keeps the records of these marriages.

Foreign consulates in Hong Kong have no right to check marital status directly. To apply for residence or a visa abroad later, you must submit a certified copy of your Hong Kong marriage certificate and a translation.

Protecting privacy and preventing misuse of information

Since October 2019, Hong Kong has tightened access to birth and marriage records. To search someone else’s record, you need the person’s authorisation or must state your reason to the Immigration Department.

In the past, some people misused searches to make public the marriage records of public figures or celebrities, causing harassment and threats. If there is reasonable suspicion that the information will be used unlawfully, the Immigration Department may refuse the application.
