Agreeing the divorce application procedure

Divorce litigation is usually costly, so if a couple agree on maintenance, child support and similar matters before divorcing, it helps cut the cost in money and time.

Agreeing maintenance in a divorce application

Since both sides’ incomes may change in future, the amount of maintenance may also be adjusted.

So the benefit of a lump-sum payment is that maintenance can be settled in a short time, with no need to revisit it later.

Agreeing custody in a divorce application

Before or after the divorce, you must think carefully about the children’s living arrangements, their education and their choice of activity classes.

For families with children under 18, the application must state clearly how custody and access are to be handled.

Agreeing the division of property in a divorce application

When dividing property, the “equal division principle” can be used to split the assets 50/50 between the two spouses.

However, other factors must also be taken into account when the “equal division principle” is applied.

Mong Kok Divorce Fees and the Fastest Way to Divorce: Filing a Divorce Petition

The petitioner must complete the “divorce petition” and deliver it in person to the Family Court Registry.

When you file a divorce petition, you need to complete:

  • Form 2: Petition for divorce (the form you need depends on your circumstances or ground for divorce)
  • Form 2B: Statement as to the arrangements for children (where applicable)
  • Form E: financial statement (where applicable)
  • Form 3: Notice of Proceedings
  • Form 4: Acknowledgement of Service (you only fill in the case number and both names; the respondent completes the rest)

The fastest way to divorce: serve the petition on your spouse

You are the “petitioner” in the case, and your spouse is the “respondent”.

After filing the petition, you must arrange for a sealed copy of the petition (a copy stamped by the court) to be served on all other parties to the proceedings, either by a person acting for you or by post.

Please note

  1. You may not serve the petition on the respondent yourself. It must be served by someone else or by post.

If the petition cannot be served on the respondent by a person or by post, you can ask the court for permission to publish it in a newspaper as another way of serving it.

For a joint application, the petition does not need to be served on the other spouse.

The Fastest Way to Divorce: Fixing a Hearing Date, Decree Nisi and Decree Absolute

After the petition has been served, you must use the application form from the Family Court Registry to ask the Registrar for directions so that a hearing can be listed.

Your petition or joint application will be listed for a hearing in one of the following categories:

Case categories and fees

Fees
Special Procedure List HK$630
Defended List HK$1,045

Before a petition is listed for a hearing, the Registrar must be satisfied that the petition has been served on the respondent.

Service on the respondent can be shown in either of these two ways:

  • The respondent has returned the completed Form 4 (Acknowledgement of Service) to the court
  • The person who served the papers has filed an affidavit with the court stating that the petition was served on the respondent

For a joint application, as soon as the documents are complete (the application does not have to be served on the other spouse), the case can be listed for a hearing.

The Registrar will decide the date, place and time of the hearing and will notify you and all parties to the proceedings.

The fastest way to divorce: decree nisi

The court will grant a decree nisi (similar to a provisional order) dissolving the marriage. Neither spouse needs to attend a hearing.

If you file a divorce petition but the “respondent” does not file an answer with the court within the set time, the petition will be handled as a Special Procedure case.

The fastest way to divorce: the decree absolute

45 days after the court grants a decree nisi, the petitioner can return the completed “Notice of Application for Decree Nisi to be made Absolute” to the court to apply to make the decree nisi absolute.

Please note

  1. A decree nisi cannot be made absolute until the court has declared its arrangements for the children.

When the Registrar is satisfied that all the legal requirements have been met, a certificate of decree absolute will be issued to both spouses.

In Hong Kong, the simplest divorce, where both sides agree, can be completed in about 6-9 months.

You can only file a divorce petition after at least 1 year of marriage, unless the court gives permission.

Ways to prove separation:

  • The petitioner’s tenancy agreement and utility bills, marked with the address, can all serve as proof of separation
  • A solicitor can also send your spouse a letter as soon as you separate, recording the fact and date of separation
  • The petitioner keeps a copy of the letter as evidence for the later divorce application

As long as the marriage is valid and can be proved to exist, a divorce can in general be handled in Hong Kong, wherever the wedding took place.
