The fastest way to divorce starts with filing the divorce petition. The petitioner must complete the divorce petition form and deliver it in person to the Family Court Registry.
When you file a divorce petition, you need to fill in:
- Form 2: Petition for divorce (the form you need depends on your circumstances or ground for divorce)
- Form 2B: Statement as to the arrangements for children (where applicable)
- Form E: financial statement (where applicable)
- Form 3: Notice of Proceedings
- Form 4: Acknowledgement of Service (you only fill in the case number and both names; the respondent completes the rest)
Serving the petition on your spouse
You are the “petitioner” in the case, and your spouse is the “respondent”.
After you file the petition, you must arrange for a sealed copy (a copy stamped by the court) to be served on the other parties to the proceedings, either by hand or by post.

Yuen Long Divorce Costs: Fixing the Hearing Date and Decree
After the petition has been served, your petition or joint application will be listed for hearing by category. The categories and fees are as follows:

You must use the application form from the Family Court Registry to ask the Registrar for directions, so that a hearing can be listed.
Before a petition is listed for a hearing, the Registrar must be satisfied that the petition has been served on the respondent.
Service on the respondent can be shown in either of these two ways:
- The respondent has returned the completed Form 4 (Acknowledgement of Service) to the court
- The person who served the papers has filed an affidavit with the court stating that the petition was served on the respondent
For a joint application, as soon as the documents are complete (the application does not have to be served on the other spouse), the case can be listed for a hearing.
The Registrar will decide the date, place and time of the hearing and notify you and all the parties.
Decree nisi
The court will grant a decree nisi (similar to a provisional order) dissolving the marriage. Neither spouse needs to attend a hearing.
If you file a divorce petition but the “respondent” does not file an answer with the court within the time set, the petition will be dealt with as a Special Procedure case.
The final order of divorce
Once 45 days have passed since the court granted the decree nisi, the petitioner can return the completed “Notice of Application for Decree Nisi to be made Absolute” to the court.
With it, the petitioner applies to make the decree nisi absolute.
When the Registrar is satisfied that all the legal requirements have been met, a certificate of decree absolute will be issued to both spouses.
