Divorce legal aid in Hong Kong: how lawyers’ fees work and how long the process takes

Divorce procedure About 8 minutes to read
Key points
  • Divorce cases fall under the Civil Legal Aid Scheme. Your disposable income and disposable assets combined must not exceed HK$449,620.
  • From application to approval takes about three months on average. If documents are missing or need to be added, it can take longer.
  • Legally aided people pay a contribution based on their means, from 0 to 25%, capped at about HK$112,405.
  • If you win, the Legal Aid Department has the right to recover what it advanced first, under the “first charge”. If you lose, you only bear the contribution you originally paid.

In Hong Kong, legal costs worry many people facing divorce proceedings. If your means are limited, “divorce legal aid” lets a government-funded lawyer handle your case and eases the financial strain.

To get divorce legal aid you must qualify. It also helps to know how applications are assessed, how lawyers’ fees are arranged, and roughly how long a case takes from application to finish.

The Legal Aid Department: its purpose, and where divorce legal aid fits

Hong Kong’s legal aid system is run in full by the Legal Aid Department, which was set up in 1970.

Its core aim is that anyone in Hong Kong, whatever their income, can get fair legal representation. In other words, ordinary people can afford to go to court.

  • The Department sits under the Office of the Chief Secretary for Administration and is overseen by the Legal Aid Services Council.
  • The Council’s members include solicitors, barristers and lay members of the public, which balances professional expertise with public trust.
  • The Department has more than 500 staff, based mainly at its Admiralty headquarters, its Family Branch in Wan Chai and its Mong Kok branch.

Family cases such as divorce, child maintenance, spousal maintenance and division of property all fall under Category 2, the Civil Legal Aid Scheme.

Legal aid comes in three categories:

Main coverage
Category 1: Criminal Legal Aid Scheme Mainly covers criminal trials and appeals
Category 2: Civil Legal Aid Scheme The main route for divorce cases
Category 3: Supplementary Legal Aid Scheme For civil claims involving large sums

The current financial eligibility limit is HK$449,620. If your assets and income are below this figure, you can formally apply for divorce legal aid.

Please note

  1. If you are applying for legal aid precisely in order to divorce your spouse, your spouse’s assets are not counted.
  2. This is a deliberate fairness rule. Counting the other side’s property when a marriage has broken down would leave the applicant with no way out.

How long divorce legal aid takes, why it can be slow, and where to go in Hong Kong

Under the Department’s standard procedure, approval takes about three months on average from application. Getting a result in around 90 days is normal for an ordinary case.

Two rounds of checks take place in that time:

  • Means test: confirms whether you meet the financial limit.
  • Merits test: confirms the case has a legal basis and a reasonable chance of success.

If documents are missing or more are needed, it can take longer. If the case is an emergency, such as domestic violence or urgent child maintenance arrangements, you can ask for “priority handling”.

Please note

  1. This is only the time needed to approve legal aid. It does not mean the divorce is finished in three months.
  2. The divorce hearing, division of property and disputes over the children can still take six months to a year, or longer, depending on how contested the case is.

Why is divorce legal aid slow?

Legal aid uses public money, so it has to be checked carefully. If everyone who claimed to have “no money” were approved, the system would have collapsed long ago.

The checks include:

  • Checking bank statements
  • Looking up tax records
  • Verifying details at an interview
  • Reviewing the case documents

If your information is clear, you usually get a reply within three months.

Suggestion

  1. While you wait, you can prepare your divorce papers, such as the marriage certificate, details of your children, a list of assets and records of major expenses. This makes things easier for your lawyer later.

Legal Aid Department offices across Hong Kong

Services are mainly provided at three locations:

  • Admiralty headquarters: handles civil and criminal legal aid applications, costs and enforcement of judgments.
  • 30th floor, Revenue Tower, Wan Chai (Family Branch): deals specifically with divorce, child maintenance, spousal maintenance and other family cases.
  • Mong Kok Government Offices, Luen Wan Street, Mong Kok: handles civil legal aid and vetting for Kowloon.

If you have limited mobility or are held in custody, you can ask Correctional Services Department staff to contact the Legal Aid Department for you. Forms can also be downloaded from the Department’s website, so applicants can see in advance which documents are needed.

Who qualifies for divorce legal aid: the means test, how assets are counted and the merits test

To apply for divorce legal aid you must first pass the Department’s means test: your “disposable income” and “disposable assets” combined must not exceed HK$449,620.

Disposable income is your average monthly income after reasonable expenses. Rent, daily living costs, rates and the cost of supporting children can all be deducted. A simple example:

Amount
Monthly income $25,000
Rent $8,000
Rates $2,000
Own expenses $5,000
Two children, in total $6,000
Disposable income left $4,000
One year $48,000
  • Disposable assets include cash, savings, shares, funds, jewellery, vehicles and the net value of property.
  • If you own your home, the outstanding mortgage can be deducted first. For example, a home worth HK$5 million with HK$3 million still owed to the bank counts as HK$2 million.

If you are aged 60 or over, the Department gives an “asset discount” to allow for future medical and retirement needs.

Proof of your finances: the more complete it is, the faster the approval

The Department goes by documents, not by word of mouth. You generally need to provide:

  • Bank statements for the last 3 to 6 months (all accounts, including secondary accounts).
  • Payslips for recent months, or income records if you are self-employed.
  • Salaries tax assessment notices.
  • Rent receipts and mortgage documents.
  • A list of your shares or insurance assets.

Please note

  1. If anything is missing or looks deliberately concealed (such as sudden large transfers or frequent withdrawals), the Department may suspect “transfer of assets” and refuse the application or delay the review.
  2. More seriously, if forgery is found, it may be a criminal offence.

Do not try to make money “disappear”: the consequences can be serious

Many people believe street rumours that spending everything or changing the name on an account will get them through. In fact the Department checks very strictly and, where needed, makes enquiries of banks or the Inland Revenue Department.

If a false statement is found, you may face a fine or imprisonment, and you will be put on a “blacklist”, which makes it hard to get legal aid again.

Being honest can even bring flexibility. Individual officers may take your real family burdens into account, for example if you care for sick parents or have long-term medical costs.

The merits test: not every divorce needs legal aid

After the means test comes the merits test, which mainly assesses whether the case has reasonable legal grounds. For divorce legal aid it usually looks at five grounds:

  • Adultery by your spouse
  • Behaviour by the other side that means you cannot reasonably be expected to live together
  • Desertion for more than one year
  • Separation for one year (both sides agree to the divorce)
  • Separation for two years (even if the other side does not agree)

Not every divorce needs legal aid

  1. If you have lived apart for many years, have no children, have clear finances and both agree to the divorce, the Department may decide no lawyer is needed, and you can file a “simple divorce application” yourself.
  2. But where custody of the children or a property dispute is involved, an application is reasonable.

The fairness rule: your spouse’s assets are not counted

Divorce cases are one of the few exceptions. The Department does not count the other spouse’s assets, so that a wife is not refused aid for being poor just because her husband is rich.

For example, a wife has a low income but her husband is wealthy. If she applies for divorce legal aid in order to leave the marriage, the Department counts only her own means.

Refused? You can seek a review, and there are alternatives

If divorce legal aid is refused, the Department sends a written notice explaining why. You can appeal to the Registrar of the High Court.

If you believe the Department misjudged your finances or the merits of the case, an appeal can succeed. If you are still refused, you can consider:

  • The Law Society of Hong Kong’s community pro bono legal advice
  • Free lawyer services at women’s or family support centres
  • The government’s family mediation service (for those willing to settle peacefully)

Divorce legal aid and lawyers’ fees: contributions, the first charge and costs after winning or losing

Many people wrongly think that “with legal aid you pay nothing”. In fact a legally aided person must pay a “contribution” according to their means.

The contribution is calculated as a proportion of your assets, from 0 to 25%, capped at about HK$112,405:

  • Those with low means can be exempt entirely.
  • A mid-range applicant pays around 10%.
  • Those close to the limit pay about a quarter.

Only after the full contribution is paid will the Department formally assign a lawyer. If you do not pay, or fall behind beyond the deadline, legal aid can be revoked.

The Legal Aid Department’s first charge

If you successfully recover property or maintenance in the divorce, the Department has the right to “recover first” the costs it has advanced out of that sum. This is called the “first charge”.

Amount
Costs paid out by the Legal Aid Department HK$150,000
Contribution paid by the assisted person HK$20,000
Costs recovered in the case HK$50,000
Property recovered in the case HK$2 million
Deducted first by the Department (HK$150,000 minus HK$20,000 minus HK$50,000) HK$80,000
Left to you after the deduction HK$1.92 million

If the property involved is real estate, the Department registers a first charge with the Lands Department. When the property is later sold, this amount must be repaid first before the buyer can obtain clear title.

Who pays the lawyers’ fees?

Lawyers on divorce legal aid come from the Legal Aid panel list, which includes more than a thousand solicitors and barristers. The government pays them at legal aid rates, which are usually lower than market rates.

You do not pay any extra lawyers’ fees. Apart from the contribution, you have no other costs.

Working with your lawyer: be proactive and honest

Your lawyer will keep in regular contact, help gather evidence, draft documents and appear in court. Do not assume you can sit back and wait once legal aid is granted.

Please note

  1. You must hand over evidence, reply to letters and attend meetings promptly. If you delay or refuse to cooperate, the Department has the right to end your support.

How costs work after a win or a loss

If you winIf you lose
Costs The court will usually order the losing side to pay costsYou still need not fear “bankruptcy”, because legal aid has a cap that protects you
Your burden If the other side pays enough to cover what the Department spent, you may even get a refundHowever high the other side’s costs are, you only pay your original contribution; nothing more is claimed

This is why legal aid is called a “shield for low-income people”.

Understanding the reasonable settlement principle

Please note

  1. If during the case your lawyer thinks the other side’s settlement offer is reasonable but you insist on refusing it, the Department may withdraw legal aid.
  2. The reason is that legal aid is a public resource and should not be used to support unreasonable litigation.

How to apply for divorce legal aid in Hong Kong, and what to watch for

Prepare three types of file before you apply. The more complete they are, the faster approval comes:

  • Identity documents: Hong Kong identity card, passport, your children’s birth certificates.
  • Case documents: marriage certificate and supporting evidence (police reports, medical reports, tenancy records, proof of separation and so on).
  • Financial proof: bank statements, passbooks, payslips, tax bills, rent and mortgage documents, and details of shares and insurance.

How to submit your application

  • In person: it is best to phone for an appointment. For divorce cases, it is advisable to go to the 30th floor of the Revenue Tower in Wan Chai.
  • Online: upload your documents through the Legal Aid Electronic Services Portal.
  • In person, you can ask questions on the spot, and hand in any missing documents there and then.

The interview

The Department often invites applicants for an interview to check that their information is genuine. It will ask about:

  • Sources of income and expenses
  • How the problems in the marriage arose
  • The children’s care and support
  • Whether there is property to be divided

Please note

  1. Just answer truthfully. This is not a trial.
  2. If you are not honest and the Department later finds the information is wrong, it can withdraw legal aid immediately.

After legal aid is granted: assignment of a lawyer and opening the case

  1. Receiving the “Legal Aid Certificate”

Once approval is granted, the certificate states the contribution amount and the scope of the aid

  2. Pay

After you pay, the Department assigns a lawyer

  3. The first meeting

Your lawyer explains the steps of the divorce procedure, including filing the application, serving notice, the court timetable, the first hearing and interim orders

Your rights and duties while the case runs

  • You can ask about the progress of the case and your legal options
  • You have the right to ask your lawyer for regular updates
  • If you are unhappy with your lawyer’s service, you can ask for a change
  • Never sign an agreement with the other side on your own; speak to your lawyer first

Open communication is the key to a smooth case.

If divorce legal aid is refused or withdrawn, and the key points at a glance

If the Department refuses your application, you can appeal or ask for a review within the time limit. You can represent yourself in court or instruct a lawyer.

If that does not succeed, you can turn to legal support from other organisations, or try “family mediation” to reduce legal costs.

The Department may withdraw legal aid in these situations:

  • Contribution unpaid for more than 30 days
  • Deliberately hiding assets or changes in income
  • Not cooperating with your lawyer
  • Refusing a reasonable settlement
  • Being away from Hong Kong for more than six months without notice

Please note

  1. After withdrawal, the Department can claim back the costs it advanced. Depending on how complex the case is, this can run from tens of thousands to several hundred thousand dollars.

Divorce legal aid gives people in Hong Kong a fair starting point

In Hong Kong, divorce should not be only for those who can afford lawyers’ fees.

The legal aid system exists to protect every resident’s right to defend their interests lawfully, even at their most vulnerable moment.

Whether you are worried about how long divorce legal aid takes to be approved or how much the lawyers’ fees are, if you prepare your documents well, declare honestly and cooperate with the Department, you have a good chance of getting professional support.

A helpful mindset once you have legal aid

  1. A divorce case is not only a legal fight but a psychological one. Look after yourself and your family, and stay calm and disciplined.
  2. A lawyer can handle the legal side, but your future life is still yours to plan again. Legal aid is only the start of getting out of a difficult situation.

Key points at a glance

  1. Divorce legal aid is a civil scheme, with a financial limit of HK$449,620
  2. Approval takes about three months on average (how long depends on how complete your documents are)
  3. The contribution is 0 to 25% of your assets, up to HK$112,405
  4. Your spouse’s assets are not counted
  5. If you win you can recover costs; if you lose, the most you lose is your contribution
  6. Urgent cases can ask for faster handling
