What to know before applying for a fast divorce in Tsuen Wan or anywhere in Hong Kong
Reaching agreement on maintenance and the children's arrangements before you decide on divorce helps reduce the burden of time and money.
Agreeing the divorce application procedure
Divorce proceedings often come with significant legal costs.
Agreeing maintenance in a divorce application
Because each party's income may change in future, the amount of maintenance may also need to be adjusted.
The advantage of paying maintenance as a lump sum is that the financial issues are settled quickly, and you avoid the trouble of making adjustments later when your finances change.
Agreeing custody in a divorce application
Before or after a divorce, think carefully about the children’s living arrangements, education and activity classes.
Please note
- Where a family has children under 18, the divorce application must state clearly how custody and access are to be handled, so that the children’s interests are fully protected.
Agreeing the division of property in a divorce application
When dividing property, the “equal division principle” can be used to split the assets 50/50 between the two spouses.
However, other factors must also be taken into account when the “equal division principle” is applied.
Divorce costs in Tsuen Wan: the fastest way to divorce
In Hong Kong, the simplest divorce, where both sides agree, can be completed in about 6-9 months.
Filing the divorce petition
When you file a divorce petition, you need to complete:
- Form 2: Petition for divorce (the form you need depends on your circumstances or ground for divorce)
- Form 2B: Statement as to the arrangements for children (where applicable)
- Form E: financial statement (where applicable)
- Form 3: Notice of Proceedings
- Form 4: Acknowledgement of Service (you only fill in the case number and both names; the respondent completes the rest)
The petitioner must complete the “divorce petition” and deliver it in person to the Family Court Registry.
Serving the petition on your spouse
You are the “petitioner” in the case, and your spouse is the “respondent”.
After filing the petition, you must arrange for a sealed copy of the petition (a copy stamped by the court) to be served on all other parties to the proceedings, either by a person acting for you or by post.
Please note
- You may not serve the petition on the respondent yourself. It must be served by someone else or by post.
- If the petition cannot be served on the respondent by a person or by post, you can ask the court for permission to publish it in a newspaper as another way of serving it.
- For a joint application, the petition does not need to be served on the other spouse.
Setting the court hearing date
After the petition has been served, you must use the application form from the Family Court Registry to ask the Registrar for directions so that a hearing can be listed.
Your petition or joint application will be listed for a hearing in one of the following categories:
| Fees | |
|---|---|
| Special Procedure List | HK$630 |
| Defended List | HK$1,045 |
Before a petition is listed for a hearing, the Registrar must be satisfied that the petition has been served on the respondent.
Service on the respondent can be shown in either of these two ways:
- The respondent has returned the completed “Form 4” to the court.
- The person who served the papers files an affidavit with the court stating that the petition has been served on the respondent.
For a joint application, as soon as the documents are complete (the application does not have to be served on the other spouse), the case can be listed for a hearing.
The Registrar will decide the date, place and time of the hearing and will notify you and all parties to the proceedings.

The fastest way to divorce: decree nisi and decree absolute
The court will grant a decree nisi (similar to a provisional order) dissolving the marriage. Neither spouse needs to attend a hearing.
If, after you file a petition for divorce, the “respondent” does not file an answer with the court within the time allowed, the divorce petition is dealt with as a Special Procedure case.
The final order of divorce
Once 45 days have passed since the court granted the decree nisi, the petitioner can return the completed “Notice of Application for Decree Nisi to be made Absolute” to the court to apply for the decree absolute.
When the Registrar is satisfied that all the legal requirements have been met, a certificate of decree absolute will be issued to both spouses.
Please note
- A decree nisi cannot be made absolute until the court has declared its arrangements for the children.

How to prove separation
- The petitioner’s tenancy agreement, utility bills and similar documents showing the address can be used as proof of separation.
- In addition, as soon as the two of you separate, a solicitor can send your spouse a solicitor’s letter that records the fact and date of the separation.
- The petitioner keeps a copy of the letter as evidence for the later divorce application.
