What to know before applying for a quick divorce in Tuen Mun or anywhere in Hong Kong
Before applying for a quick divorce in Tuen Mun or anywhere in Hong Kong, you need to understand the divorce procedure and reach agreement on maintenance, custody and division of property.
Agreeing the divorce application procedure
- Once you decide to go to court for a divorce, the litigation costs are usually high.
- So before you consider divorce, reaching agreement on maintenance, child arrangements and similar matters can cut the time and money involved.
Agreeing maintenance in a divorce application
- Because both sides’ incomes may change in future, the amount of maintenance may also need to be adjusted.
- The advantage of paying maintenance as a lump sum is that the financial issues are settled quickly, and you avoid the trouble of financial adjustments later.
Agreeing custody in a divorce application
- Before or after a divorce, think carefully about the children’s living arrangements, education and activity classes.
- Where a family has children under 18, the divorce application must state clearly how custody and access are to be handled, so that the children’s interests are fully protected.
Agreeing the division of property in a divorce application
- When dividing property, the “equal division principle” can be used to split the assets 50/50 between the two spouses.
- However, other factors must also be taken into account when the “equal division principle” is applied.
The fastest way to divorce: file a divorce petition
The petitioner must complete the “divorce petition” and deliver it in person to the Family Court Registry.
When you file a divorce petition, you need to fill in:
- Form 2: Petition for divorce (the form you need depends on your circumstances or ground for divorce)
- Form 2B: Statement as to the arrangements for children (where applicable)
- Form E: financial statement (where applicable)
- Form 3: Notice of Proceedings
- Form 4: Acknowledgement of Service (you only fill in the case number and both names; the respondent completes the rest)
Serving the petition on your spouse
You are the “petitioner” in the case, and your spouse is the “respondent”.
After you file the petition, you must arrange for a sealed copy (a copy stamped by the court) to be served on the other parties to the proceedings, either by hand or by post.
Please note
- You may not serve the petition on the respondent yourself.
- The petition must be served by a third party or by post.
If the petition cannot be served on the respondent by a person or by post, you can ask the court for permission to publish it in a newspaper as another way of serving it.
For a joint application, the petition does not need to be served on the other spouse.

Fixing a court hearing date, the decree nisi and the decree absolute
After the petition has been served, you must use the application form from the Family Court Registry to ask the Registrar for directions, so that a hearing can be listed.
Your petition or joint application will be listed for hearing under the categories below. The case categories and fees are as follows:
| Fees | |
|---|---|
| Special Procedure List | HK$630 |
| Defended List | HK$1,045 |
Before a petition is listed for a hearing, the Registrar must be satisfied that the petition has been served on the respondent.
Service on the respondent can be shown in either of these two ways:
- The respondent has returned the completed Form 4 (Acknowledgement of Service) to the court
- The person who served the papers has filed an affidavit with the court stating that the petition was served on the respondent
For a joint application, as soon as the documents are complete (the application does not have to be served on the other spouse), the case can be listed for a hearing.
The Registrar will decide the date, place and time of the hearing and notify you and all the parties.
Decree nisi
The court will grant a decree nisi (similar to a provisional order) dissolving the marriage. Neither spouse needs to attend a hearing.
If you file a divorce petition and the respondent does not file an answer with the court within the set time, the petition is dealt with as a Special Procedure case.
The final order of divorce
45 days after the court grants the decree nisi (the first order, which is not yet final), the petitioner may return the completed “Notice of Application for Decree Nisi to be Made Absolute” to the court, to apply to turn the decree nisi into a decree absolute (the final order).
When the Registrar is satisfied that all the legal requirements have been met, a certificate of decree absolute will be issued to both spouses.
Please note
- A decree nisi cannot be made absolute until the court has declared its arrangements for the children.

How quickly can a divorce be completed in Hong Kong, how long after marriage can you apply, and can a marriage abroad be ended in Hong Kong? The answers are below:
- In Hong Kong, the simplest divorce, where both sides agree, can be completed in about 6-9 months.
- You can only file a divorce petition after at least 1 year of marriage, unless the court gives permission.
- As long as the marriage is valid and can be proved to exist, a divorce can in general be handled in Hong Kong, wherever the wedding took place.
Ways to prove separation:
- The petitioner’s tenancy agreement, utility bills and similar documents showing the address can be used as proof of separation.
- In addition, as soon as the two of you separate, a solicitor can send your spouse a solicitor’s letter that records the fact and date of the separation.
- The petitioner keeps a copy of the letter as evidence for the later divorce application.
