Divorce before your first anniversary: reasons, procedure and conditions

Divorce procedure Reading time: about 7 minutes
Key points
  • Under the Matrimonial Causes Ordinance (Cap. 179), spouses must have been married for one year before they can apply for divorce. If you have been married for less than a year, the court will in principle not accept your application.
  • If you can prove “exceptional hardship” or “exceptional depravity”, the court may use its discretion to accept an application, but successful cases are extremely rare.
  • Judicial separation is not subject to the one-year rule and can be applied for at any stage of a marriage, but you both remain legally married.
  • A decision to divorce should come from calm thought, not a moment of impulse, and should weigh finances, the children's welfare and your own happiness.

In Hong Kong, the marriage law generally means you cannot apply for divorce straight away if you have been married for less than a year, although there are exceptions in special circumstances.

This article explains the reasons for divorce within the first year of marriage, and the procedure and conditions for applying.

Divorce Before One Year of Marriage in Hong Kong: Restrictions and Options

Under the Matrimonial Causes Ordinance (Cap. 179), spouses must have been married for one year before they can apply to the court for divorce. If you have been married for less than a year, the court will in principle not accept your application.

The rule is meant to protect the seriousness of marriage, to stop people treating their marriage vows lightly, and to give newly married couples enough time to adjust to living together.

Ending the marriage In principle not accepted before one yearIn theory, can be arranged straight after the wedding

Exceptions to the one-year rule in special circumstances

You generally have to be married for one year before you can apply for divorce, but section 12 of the Matrimonial Causes Ordinance sets out exceptions.

If you can prove one of the following, the court may use its discretion to accept an application made within the first year of marriage:

  • You yourself are suffering “exceptional hardship”
  • The respondent has shown “exceptional depravity”

The court looks at the whole picture, including but not limited to the best interests of any children of the marriage and the chance of the couple reconciling.

Judges usually weigh the special features of each case carefully against the principle of protecting marriage.

Please note

  1. Successful applications under this exception are extremely rare, because the legal standards for “exceptional hardship” and “exceptional depravity” are set high and are vague.
  2. Ordinary marital disputes, poor communication or fading affection are usually not enough to amount to “exceptional hardship”.
  3. Unless the conduct is extremely serious, such as severe domestic violence or major fraud, it is also hard to persuade the court that it is “exceptional depravity”.

The difficulty and challenge of proving special circumstances

When you apply before one year of marriage, the biggest challenge is proof. You need to provide specific, detailed and strong evidence.

This kind of evidence may include:

  • Medical reports (for example, mental or physical health problems caused by stress in the marriage)
  • Police reports (for example, incidents of domestic violence)
  • Witness statements
  • Professional psychological assessment reports

Spoken accounts or personal feelings alone are usually not enough to support this kind of application.

The law does not clearly define “exceptional hardship” or “exceptional depravity”. This leaves judges wide discretion and makes the outcome of an application less certain.

You also have to explain why your situation is so urgent that you cannot wait until you have been married for a year, which makes approval harder still.

The court is particularly careful when hearing these cases, to prevent the exception from being abused.

Practical alternatives if you have been married less than a year

Because of the legal restriction on divorce within the first year, legal professionals usually suggest two main alternatives:

  • Wait patiently until you have been married for a year, then apply for divorce. This is the most direct and certain route.
  • Apply for a “judicial separation order”, which is not subject to the one-year rule and can be applied for at any stage of a marriage

While you wait, you can prepare the necessary documents, gather evidence, and even try marriage mediation, so that you can be sure divorce really is the best choice.

You can also use this time to think through arrangements for dividing property and raising the children.

Once you have been married for a year, a separation order can be converted into a divorce decree relatively easily, so you do not have to start the whole divorce process again.

The effect and procedure of judicial separation

Judicial separation has an effect similar to divorce, with important differences. Once it is granted:

  • You may lawfully live apart and no longer have a duty to live together
  • The court makes arrangements for custody of and access to the children, to protect their interests
  • Division of property and maintenance are also dealt with and decided, with the same effect as the corresponding orders in a divorce judgment

The procedure for applying for judicial separation is relatively simple:

  1. File a petition for judicial separation

The petitioner files a petition for judicial separation in the District Court or the High Court, stating the grounds, such as unreasonable behaviour, desertion or the fact of separation.

  2. The court arranges a hearing

After you file, the court arranges a hearing.

  3. The court grants the judicial separation order

If the court finds the grounds sufficient, it grants a judicial separation order.

Please note

  1. The key limit of judicial separation is that you both remain legally married and cannot enter a new marriage. If either of you wants to remarry, you must still wait until you have been married for a year and convert the judicial separation into a divorce decree.

Why professional help matters

Divorcing before one year of marriage is complicated. A solicitor can advise on the details of your case and can:

  • Assess how likely a special-circumstances application is to succeed, or suggest a better alternative such as judicial separation
  • Help you avoid procedural mistakes that delay your case or add unnecessary legal costs
  • Help you avoid having your application refused because of form-filling errors or insufficient evidence

For complex matters such as division of property, child arrangements and maintenance, a solicitor's expertise is especially important.

Divorce within the first year: thinking the decision through

Knowing when to hold on and when to let go is never an easy decision. Whether to divorce has to be judged on your own circumstances.

Key factors to weigh before deciding on divorce

  • Financial impact: divorce involves dividing property and possibly paying maintenance, and your finances afterwards may be very different from during the marriage
  • The children's welfare: if there are children, their welfare must come first, and custody, access and financial support for them cannot be avoided
  • Social life and family pressure: divorce can reshape your circle of friends and family relationships, and you may face misunderstanding and pressure from relatives and friends
  • Personal growth and happiness: leaving an unhealthy marriage can give you a chance to start again

Common reasons marriages break down

Marriages usually end because of some underlying problems. Common reasons are:

  • Long-standing friction and incompatibility: big differences in personality, values, interests or lifestyle that communication cannot bridge
  • Unacceptable behaviour: domestic violence, substance abuse (such as alcohol or drug addiction), gambling problems or long-term emotional coldness
  • Serious differences in goals and values: for example, one partner wants children and the other firmly does not, or you hold completely different views on money, career or family responsibilities
  • Infidelity or betrayal: an affair destroys the trust a marriage rests on, often comes with lies and deceit, and makes the relationship hard to repair

A social science view: what affects the stability of a marriage

Besides feelings, social science research has found that some objective factors also affect how stable a marriage is:

  • Age at marriage: research shows that couples who marry between 28 and 32 have the lowest divorce rate, while for those who marry after 32 the risk of divorce rises by about 5% a year
  • Marrying too young: immaturity and lack of life experience can make a marriage unstable
  • Employment: surveys show that divorce is clearly more common in households where the man works part-time than where he works full-time
  • Education: research finds that people who did not finish high school have a divorce rate about 30% higher than university graduates
  • Patterns of interaction: psychologists describe the “Four Horsemen” of marriage: criticism, defensiveness, stonewalling and contempt. If they appear often, a marriage usually struggles to last

Divorce within the first year: common misconceptions

Some marriage problems look minor but can be hidden crises. Common misconceptions include:

  • Being too romantic: research shows that couples who always stay highly intimate and romantic actually face a higher risk of divorce
  • Idealising marriage too much: many couples who divorce before their first anniversary cannot accept the friction and adjustment of real life
  • Expecting your partner to give way: a marriage needs both sides to adjust and tolerate, not one partner changing entirely to meet the other's demands
  • Poor communication: when conflict arises, one partner avoids it or turns aggressive, instead of discussing the problem calmly and rationally

Once the honeymoon period fades, couples who cannot adapt to ordinary married life may rush into divorce.

Alternatives when your marriage is in crisis

Divorce is not the only choice when a marriage is in crisis. Before making a final decision, you can consider these alternatives:

  • Marriage counselling or couples therapy: a professional counsellor can help you find the root of the problem, improve how you communicate and learn healthy ways to resolve conflict
  • A temporary separation: couples who find it hard to live together can take time to think calmly and judge whether the marriage is worth continuing
  • Judicial separation: not subject to the one-year rule and available at any stage of a marriage, but it does not end the marriage
  • Talking to friends or family: advice and support from others can bring a fresh perspective

The best time to divorce: when to decide

The best time to decide on divorce differs from person to person, but these points may help:

  • Negative feelings in the marriage (such as anger, resentment and disappointment) have long outweighed the positive ones, and you have both tried many ways to improve things without success
  • The marriage has problems that cannot be repaired, such as long-term infidelity, continuing domestic violence or an unresolvable clash of values
  • You have tried marriage counselling, better communication or a temporary separation, but the marriage has not improved

Please note

  1. A decision to divorce should come from calm thought, not a moment of impulse. If you have been married less than a year, you should take particular care to judge whether you are facing normal challenges of settling into marriage or a fundamental problem that cannot be reconciled.

Preparing yourself emotionally once you decide to divorce

Once you decide to divorce, preparing yourself well helps you get through this difficult time more smoothly:

  1. Accept mixed emotions

Sadness, anger, loss, relief and fear may come and go in turn. All of these are normal reactions.

  2. Build a support network

During a divorce, support from friends and family, and professional counselling, are very important.

  3. Plan your life after divorce

This includes financial planning, housing and work arrangements, and it can reduce uncertainty and anxiety during the divorce.

The length of a marriage does not decide its worth. Ending an unhealthy relationship in good time takes far more courage than holding on.
